And here we have why I'm glad I don't live in Alabama. Alabama Supreme Court justice Tom Parker writes en editorial deriding his fellow justices as being idiots for... following precedent and upholding the law?
Apparently he believes that Article VI of the US Constitution is unconstitutional, and that US Supreme Court rulings that he doesn't like shouldn't be followed. He also apparently can't read or count, since he argues that the changes in the Supreme Court would result in the ruling being given a new hearing and a new result. This is unlikely, since Rehnquist and O'Connor both dissented from Roper.
He doesn't try to argue that this case is any different from the precedent - he just thinks the precedent is wrong, because executing minors and retards is what Alabama is all about, and anyone who says otherwise is a liberal and hence a prime candidate for the "execute the retards" rule.
Speaking of insane US judges, the Bangor Daily News Editorial for Monday is entitled "Judge Alito's values threaten Maine's way of life". It's a good read for anyone who thinks that Alito might, say, support enforcing the law as written when it inconveniences people who pay him enough, or consider that citizens might have rights.
